NJ man sues Dunkin’ after scalding coffee badly burns him

NEW YORK (1010 WINS) — A New Jersey man is suing Dunkin’ Donuts after he suffered second- and third-degree burns by spilling coffee on his lap.

Evan Arlington spilled the scalding coffee on himself at a Totowa location of the chain on Aug. 25, 2021 and filed the lawsuit on April 4 in Passaic County.

The burns were so bad that he needed costly medical attention, according to the New York Post.

He’s seeking unspecified damages for the injuries, medical bills and disruption to his life that the burns caused.

There’s precedent for consumers to be compensated for serious coffee burns.

A similar lawsuit was mocked during a corporate campaign to limit the ability of private citizens to sue corporations.

Stella Liebeck was pilloried in the press and became the poster child for frivolous lawsuits after winning $2.7 million from McDonalds after spilling hot coffee on herself.

The part that often got left out of the initial telling of the story is that she suffered third degree burns because McDonalds was brewing its coffee at dangerously hot temperatures as a time saving measure.

Not only did Liebeck get compensated for the serious injuries she suffered, but McDonalds was also forced to brew coffee at temperatures safe for human consumption.
